Terms of Service

1. Acceptance of Terms
By accessing or using ThinSky Inc. ("ThinSky", "we", "us") services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Services
ThinSky provides managed security services including but not limited to: SOC as a Service, Virtual CISO, penetration testing, phishing simulation, and managed open source security tools. Services are provided subject to separate service agreements.
3. User Responsibilities
You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Use services only for lawful purposes
- Not interfere with or disrupt our services
- Comply with all applicable laws and regulations
4. Intellectual Property
ThinSky and its licensors retain all intellectual property rights in our services, including software, documentation, and methodologies. You receive a limited license to use our services as specified in your service agreement.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information disclosed during the engagement. This includes but is not limited to security assessments, vulnerabilities discovered, and business information.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINSKY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
7. Indemnification
You agree to indemnify and hold harmless ThinSky from any claims arising from your use of our services, violation of these terms, or infringement of third-party rights.
8. Service Level Agreement
Service levels, uptime guarantees, and response times are specified in your individual service agreement. These terms supplement but do not replace those agreements.
9. Termination
Either party may terminate services in accordance with the service agreement. Upon termination, you must cease using our services and we will assist with orderly transition of data and services.
10. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Disputes shall be resolved in the courts of Ontario.
11. Changes to Terms
We may modify these terms at any time. Continued use of services after changes constitutes acceptance of the modified terms.
